1. USER INFORMATION

Who is responsible for processing your personal data?

VICCARBE HABITAT, S. L., hereinafter referred to as the CONTROLLER, informs the USER that it has created profiles on the social networks Facebook, Instagram, X, LinkedIn, YouTube, Vimeo, Pinterest, among others, and that it is responsible for the processing of the user’s personal data carried out on those social networks. It also informs that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD). The following information on data processing is therefore provided:

Why do we process your personal data?

Purpose of processing: to maintain a relationship between the USER and the CONTROLLER, which may include the following activities:

• Handling requests and queries submitted to the controller
• Providing information about activities and events organized by the controller
• Providing information about products or services offered by the controller
• Interacting through official profiles

Why are we allowed to process your personal data?

Legal basis for processing: Article 6.1.a GDPR, the data subject has given consent to the processing of their personal data for one or more specific purposes. The USER has a profile on the same social network and has decided to join the CONTROLLER’s social network, thus showing interest in the information published there. Therefore, when requesting to follow our official profiles, the USER provides consent for the processing of the personal data published on their profile.

The USER may access the privacy policies of the social network at any time and configure their profile to ensure their privacy.

The CONTROLLER has access to and processes the USER’s public information, in particular their contact name. These data are only used within the social network itself and will only be included in a CONTROLLER-owned file when necessary to process the USER’s request.

How long will we keep your personal data?

Data retention criteria: data will be kept as long as the USER does not revoke the consent given, as indicated in this privacy policy.

Who do we share your personal data with?

Data communication: the information provided by the USER through the CONTROLLER’s social networks, including personal data, may be published depending on the services used by the USER, and may therefore be publicly available to other third-party users of the social networks. From each social network profile, the USER can configure what information they wish to make public, review granted permissions, delete them, or disable any third-party application they no longer wish to use.

No personal data will be disclosed to third parties outside the social network unless this is essential for the development and execution of the processing purposes, in which case it may be communicated to our service providers related to communications, with whom the CONTROLLER has signed the confidentiality and data processing agreements required under current data protection regulations.

What are your rights?

Rights of the USER: these may only be exercised in relation to information under the control of the CONTROLLER.

• Right to withdraw consent at any time
• Right of access, rectification, portability and erasure of their data, and restriction or objection to processing
• Right to lodge a complaint with the supervisory authority (www.aepd.es) if they believe that processing does not comply with current regulations

2. USE OF THE PROFILE

The CONTROLLER may carry out the following actions:

• Access to public profile information
• Publication on the USER’s profile of all information already published on the CONTROLLER’s social network
• Sending personal and individual messages through social network channels
• Page status updates that will be published on the USER’s profile

The USER may always control their connections, delete content they are no longer interested in, and restrict who they share connections with; to do so, they must access their privacy settings.

3. POSTS

Comments, links, images, photographs, or any other type of multimedia content supported by the platform. The USER must, in all cases, be the owner of the published content, hold the copyright and intellectual property rights, or have the consent of the affected third parties. Any publication on the social network is expressly prohibited if it infringes or may infringe morality, ethics, good taste, or decency, and/or violates intellectual or industrial property rights, image rights, or the law.

In such cases, the CONTROLLER reserves the right to immediately remove the content without prior notice and may request the permanent blocking of the USER.

The CONTROLLER shall not be responsible for content freely published by a USER.

The USER should be aware that their posts will be visible to other users, and they are therefore primarily responsible for their own privacy.

Images that may be published on the social network will not be stored in any file owned by the CONTROLLER, but will remain on the social network.

4. DATA OF MINORS OR PERSONS WITH SPECIAL CAPACITIES

Access to and registration through the CONTROLLER’s social networks is prohibited for persons under 14 years of age. If the USER has special capacities, the intervention of the holder of parental authority or guardianship, or their legal representative, will be required through a valid document accrediting representation.

The CONTROLLER shall be expressly exempt from any liability arising from the use of social networks by minors or persons with special capacities. The CONTROLLER’s social networks do not knowingly collect personal information from minors; therefore, if the USER is underage, they must not register, use the CONTROLLER’s social networks, or provide any personal information.
